If you are facing a tax litigation matter at the federal level, an experienced tax attorney can help you with any dispute you may have with the Internal Revenue Service (IRS).

History of the U.S. Tax Court

Congress established the United States Tax Court in Article I of the U.S. Constitution in order to develop a national arena for resolving tax disputes between taxpayers and the IRS, so as to provide a uniform interpretation of the provisions of the Internal Revenue Code. Taxpayers always have a right to dispute the amount of an alleged tax deficiency, or to dispute that the tax deficiency exists at all.

The Tax Court consists of 19 judges appointed by the President, as well as special trial judges and retired senior judges who serve on-call. The U.S. Tax Court is centrally located in Washington, D.C., but these judges travel across the country to various destinations to conduct trials at locations convenient to taxpayers.

How can an experienced U.S. Tax Court attorney help?

An experienced tax attorney can often work with you to postpone any tax payments you may owe until your case is resolved, but only if your case is filed within the requisite 60-day time limit. This is one reason why it is so important to work with a skilled tax attorney in New Jersey as soon as possible.

While most federal tax cases are settled without proceeding to trial, it is crucial that your tax lawyer be prepared to pursue the case all the way through trial, if necessary.

Objectives of the U.S. Tax Court

Providing uniform treatment of all federal tax cases is one of the primary goals of the U.S. Tax Court, in addition to:

  • Simplifying and streamlining procedures, especially for small-dollar cases;
  • Focusing on the merits of each tax case;
  • Prompting taxpayers to pay what they owe, but no more;
  • Providing a convenient venue for tax trials; and,
  • Respecting the rights of taxpayers who lack counsel and decide to represent themselves.
