Stripping Judgment Liens
One bankruptcy-related issue that our clients often encounter is the stripping of liens. Though filing for bankruptcy may discharge your debt, it does not discharge the lien that has been placed on your property. The amount may be stripped down to the amount that the lien is for, less the amount of the collateral on the property. This leaves the lender pursuing the debtor for only the difference, which is unsecured debt. Essentially, the bankruptcy essentially gives the lender and debtor the terms of a new loan as if credit was extended at the moment of bankruptcy filing.
